TERMS AND CONDITIONS

This document outlines the terms and conditions governing enrollment in training courses offered by QESH Training Center and Consultancy OPC (“QESH Training Center,” “we,” “us,” or “our”). By enrolling in our courses, you (“participant,” “you,” or “your”) agree to be bound by these terms.

1. Enrollment and Payment:

  • Payment Schedule:

    • Full payment is required upfront for BOSH SO1, HIRAC, First Aid courses, and all levels of Food Safety Training.

    • For BOSH SO2, COSH, LCM, SPA, Management Skills Development Training, Pollution Control Officer Training, and Accountant for Non-Accountants Training, a 50% down payment is accepted upon registration to secure your slot. The remaining balance must be paid before the commencement of the training. Down payments are not refundable.

  • Payment Requirements

    • Full payment is required upon enrollment for BOSH SO1, HIRAC, all First Aid Courses (OFAT, SFAT, and EFAT), and all levels of Food Safety Trainings.

    • For BOSH SO2, COSH, LCM, SPA, Management Skills Development (MSD), Pollution Control Officer (PCO) Training, Lean Six Sigma and Accountant for Non-Accountants Training, a 50% down payment is accepted upon enrollment, with the remaining balance required before Day 1 of the training. Down payments and reservation fees are strictly non-refundable.

  • Payment Methods:

    • Payments can be made via bank transfer, online payment gateways (such as Paymongo for Credit and Debit Card Payments), or other methods as specified by QESH Training Center.

    • Multiple enrollments can be included in a single payment, provided that all participant details are submitted with the payment confirmation.

    • Check payments are also accepted; however, they must be delivered directly to our office. As much as possible, we do not arrange check pickups, as this incurs additional messenger costs

  • Payment Confirmation:

    • To expedite enrollment, participants are required to send proof of payment (e.g.,deposit slip, screenshot of online transaction) along with the participant’s full name, contact details, and the training course enrolled in.

  • Company Sponsored Enrollment:

    • If your company requires a budget approval process leading to delayed payment, a formal letter of intent from your company is required to reserve your spot. This letter must include a clear commitment to settle the payment within a specified timeframe.

  • Value Added Tax (VAT):

    • Issuance of a service invoice is subject to a 12% VAT, which is exclusive of the training fee.

2. Cancellations and Refunds:

  • Participant Cancellations:

    • Cancellations or no-shows made within 5 working days prior to the commencement of the training session will result in the forfeiture of the full training fee.

    • Cancellations made prior to 5 working days before the training will be eligible for a refund, subject to a 10% administrative fee.

    • Any refund will be processed within 30 business days.

  • QESH Training Center Cancellations/Rescheduling:

    • QESH Training Center reserves the right to cancel or reschedule training sessions if the minimum required number of participants is not met or due to unforeseen circumstances.

    • In the event of cancellation by QESH Training Center, participants will be offered the option to reschedule the training.

    • If the new schedule was cancelled again, the payment may be refunded upon participant’s request.

  • QESH-Initiated Cancellations & Schedule Changes

    • QESH Training Center will exert all reasonable efforts to maintain announced training schedules. However, all posted schedules remain tentative and may be changed, cancelled, or rescheduled if the minimum participant requirement is not met or due to unforeseen circumstances. QESH Training Center reserves the right to cancel or reschedule any training under these conditions.

    • In the event of a cancellation initiated by QESH Training Center, participants will be given the option to reschedule to another available batch. If the training has been rescheduled twice or more by QESH, the participant is entitled to a full refund upon request. If the training has been rescheduled once by QESH and the participant chooses not to proceed, a 10% administrative fee will be deducted from the refund.

    • Tentative schedules are published in advance for participant reference, while confirmed training notices are sent two (2) to three (3) days before the confirmed training date.

  • Participant Cancellations, Rescheduling & Penalties

    • Participants who wish to reschedule their training must inform QESH Training Center at least five (5) working days before the scheduled date, regardless of when registration or payment was made, to avoid penalties and to allow proper resource allocation.

    • Cancellations or last-minute rescheduling made less than five (5) working days before the training—including cancellations a day before or on the training day—are non-refundable; however, the participant may still reschedule within six (6) months from the date of payment, subject to a penalty equal to 50% penalty of the training fee.

    • Participants who fail to attend without informing QESH will be marked as no-shows and the training fee will initially be forfeited. If the participant contacts QESH within six (6) months from the date of payment, rescheduling may still be allowed with a 50% penalty of the training fee. If no update is made within six (6) months, the payment will be permanently forfeited. The six-month validity is fixed and does not extend due to personal availability or QESH-initiated reschedules.

3. Training Materials and Liability:

  • Accuracy of Information:

    • While we make every effort to ensure the accuracy and completeness of our training materials and information provided during our courses, QESH Training Center cannot be held liable for any damages, losses, or liabilities arising from errors, omissions, or inaccuracies in these materials.

  • Intellectual Property:

    • All training materials provided are the property of QESH Training Center and are protected by copyright laws. Participants are prohibited from reproducing, distributing, or modifying these materials without our express written consent.

4. Participant Responsibilities:

  • Attendance and Participation:

    • Participants are expected to attend all scheduled training sessions and actively participate in the learning activities.

    • Participants are expected to abide by all rules and regulations set by QESH Training Center during the training.

  • Conduct:

    • Participants are expected to conduct themselves in a professional and respectful manner during training sessions. Inappropriate behavior may result in expulsion from the course without refund.

5. Data Privacy:

  • Personal Data:

    • By completing the registration form, you provide explicit consent for QESH Training Center to collect, process, and store your personal data in accordance with our Data Privacy Notice.

    • We are committed to protecting your privacy and will handle your personal information in compliance with the Data Privacy Act of 2012 and other applicable laws.

    • Please review our Data Privacy notice to understand how we handle your data.

6. Certification:

  • Eligibility:

    • Certification will be awarded to participants who successfully complete the training and meet all requirements, including attendance, participation, and passing assessments.

  • Issuance:

    • Certificates will be issued within a reasonable timeframe after the completion of the training.

7. Force Majeure:

  • QESH Training Center shall not be liable for any failure or delay in performing its obligations under these terms and conditions due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, or government regulations.

8. Amendments:

  • QESH Training Center reserves the right to amend these terms and conditions at any time. Any changes will be posted on our website or communicated to participants through other appropriate channels.

9. Governing Law:

  • These terms and conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines.

CANCELLATION AND REFUND POLICY

QESH Training Center is committed to providing high-quality training services to our clients. We understand that circumstances may arise that require you to cancel your training or request a refund. This policy outlines the terms and conditions under which cancellations and refunds may be granted.

Cancellation & Rescheduling Policy

1. Cancellation Notice:

  • If you need to cancel your training, please notify us in writing (email preferred) at least 7 business days before the scheduled training date.

  • A cancellation fee of 10% of the training fee will be charged.

  • All participant-initiated cancellations or refund requests will be subject to a 10% administrative fee deduction.

  • Participants are required to fill out the Refund Request Form and provide all necessary details for processing.

  • Once a participant cancels a refund request and chooses to continue with the training, they can no longer request a refund for that same training.

2. Rescheduling Timeline:

  • Please note that cancellations, incomplete training, no-shows, or rescheduling made less than 5 business days before the training will incur a 50% penalty of the training fee. To avoid this, kindly inform us at least 5 business days in advance. This helps us manage the schedule and ensure resources are prepared. If you're unsure of your availability, feel free to contact us to explore options and avoid additional fees.

  • If notice is not provided at least five (5) business days before the training, please refer to the Participant Cancellations section for the applicable penalties and conditions.

3. Center-Initiated Changes:

  • Due to unforeseen circumstances, we retain the authority to cancel or reschedule training sessions.

  • If we cancel or reschedule a training session, we will notify you as soon as possible and provide you with the option of:

    • Rescheduling to a different training session.

4. Training Fee Validity:

  • Training fees are valid for six (6) months from the date of payment as long as the client has not decided yet its schedule.

  • Failure to attend or utilize the training within this period will result in forfeiture of the training fee.

  • Training fees are valid for 6 months from the date of payment. Participants must complete their training within this period.

  • Personal availability or QESH-initiated reschedules do NOT extend the 6-month validity. After 6 months, the payment is forfeited, regardless of circumstances.

5. Make-Up Sessions:

  • For participants requiring a make-up class, training must be completed within 90 days from the originally scheduled session for OSH, and 30 days for FAT.

  • If the make-up session is not attended within this period, the training will be considered void, and the participant will need to re-enroll and restart the training from Day 1.

  • Participants may complete their missed sessions through a make-up class, which must be attended within 90 days from the original training date for OSH programs, and within 30 days for First Aid Training (FAT).

  • If a participant misses more than 10% of the required training hours or fails to attend the make-up session within the allowed period (90 days for OSH; 30 days for FAT), the training becomes void. The participant must retake the full training on a new schedule and settle a 50% penalty of the training fee.

6. Emergency Considerations:

  • In cases of emergencies (medical emergencies, natural disasters), exceptions to the policy may be considered upon submission of valid documentation.

  • Penalty may be waived ONLY for valid emergencies: Act of God, Natural disaster, Life-threatening medical situation, Accidents (with proof), with required documentation (e.g., medical certificate, police report, government advisory) must be submitted.

  • NOT considered valid emergencies include sudden work meetings, workload or schedule conflicts, change of mind or personal commitments, failure to check or monitor training notices, forgetting the schedule, or any similar participant-related reasons.

7. Substitute Participants:

  • If you are unable to attend, you may send a substitute participant with prior written notice (email preferred) at no additional charge but not refundable.

8. Transferring Training:

  • Training may be transferred to another training course of equal or lesser value, if the request is made in writing, and more than 5 business days prior to the original training. If the new training is of higher value, the participant must pay the difference in cost.

  • Participants may request to transfer to a different training course if the request is made at least five (5) working days before the original training date. If the new course has a higher fee, the participant must pay the difference. If the new course has a lower fee, the price difference is non-refundable but may be converted into available QESH merchandise, shipping fees, or any equivalent item or service offered by QESH Training Center.

  • Transfer requests made less than five (5) working days before the training, including those made on the training day itself, are still allowed but will incur a penalty equivalent to 50% of the training fee. Transfers made on the training day remain non-refundable and are still subject to the same 50% penalty.

Refund Policy:

1. Eligibility for Refund:

  • To be eligible for a refund, you must provide us with detailed written feedback on the reasons for your dissatisfaction and any suggestions for improvement.

2. Refund Processing:

  • Refunds will be processed on the 14th and 29th of each month.

  • Refund requests must be submitted with complete feedback within two business days before the processing dates.

3. Refund Method:

  • Refunds will be issued in the same form of payment as the original payment, unless otherwise agreed upon in writing.

4. Partial Completion:

  • No refunds will be issued for partial completion of a training course or for missed training sessions.

5. Non-Refundable Fees:

  • All registration, administrative, and materials fees are generally non-refundable; however, should QESH Training Center initiate a session cancellation for the second time, participants will receive a full refund, encompassing all fees, if they choose not to reschedule.

6. Discounted/Promotional Training:

  • No refunds will be issued for discounted or promotional training sessions.

  • Participants may reschedule within the validity period of the promotion, subject to availability.

7. Refund Timelines:

  • Refunds may take up to 14 business days to reflect in your account, depending on your payment provider.

8. Dispute Resolution:

  • If you disagree with a refund decision, you may submit a written appeal, which will be reviewed by the training center’s management team within 7 business days. The management team’s decision is final.

9. Force Majeure:

  • In events beyond our control (pandemics, government restrictions, natural disasters, utility failure), refunds or rescheduling options will be handled on a case-by-case basis, prioritizing fairness and mutual understanding.

  • QESH Training Center will make every effort to provide online training, or other alternative training methods, before cancellation.

By enrolling in our training courses, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions.
